Orders are placed online through the Webshop, using an order form and subject to product availability. If the Product is no longer available after the order has been placed, Vorwerk Romania must inform the customer within a reasonable period. The customer can obtain additional information about the Products from Vorwerk Romania customer service.

The sale is considered concluded only after express acceptance by Vorwerk Romania. However, Vorwerk Romania reserves the right not to fulfil or to cancel orders, with reimbursement of any advance payment made, if they appear suspicious, including but not limited to orders placed by minors, insolvent customers, customers without a known address, or customers providing false information.

Vorwerk Romania reserves the right to suspend or refuse any order from a customer who has not paid for a previous order or with whom there is an ongoing dispute. Placing an order means that the customer has fully accepted the GTC.

The Product is invoiced at the price applicable at the time the order is registered. Prices are expressed in euros, including all taxes. Delivery costs are borne by the customer and are indicated separately.

In the event of late payment and without prior notice, (i) late payment interest shall be automatically due at the legal interest rate, and (ii) the outstanding balance shall automatically be increased by a fixed compensation amounting to 10% of the amount due, with a minimum of 125 euros. The parties agree that this represents a reasonable estimate of the fixed compensation, which may be increased or reduced if the interested party provides evidence to the contrary. In the event of judicial recovery, all recovery costs shall be borne by the customer. An incomplete delivery of an order does not justify postponing payment for the goods delivered. Vorwerk Romania may issue partial invoices to the extent that goods have been delivered. Payment of invoices cannot be made conditional upon the installation and commissioning of the equipment.

Delivery deadlines are not binding and are provided for guidance only, unless expressly stated otherwise. The risks are transferred to the customer when the customer or a third party designated by the customer takes physical possession of the Produ

The Products sold remain the property of Vorwerk Romania until full payment of the price and any other amounts owed by the customer has been received. The customer is responsible for any damage or depreciation of the Product compared to its new condition, resulting from use, damage to the packaging, etc. In the event of seizure, confiscation, or any other measures taken by third parties regarding the Product, for any reason, the customer fully indemnifies Vorwerk Romania against any resulting claims and costs. In such cases, the customer must inform the third party that the Product is the property of Vorwerk Romania. If the price is not paid in full within the agreed period, Vorwerk Romania may, at its own discretion, request the return of the Product, either by refunding any amounts already paid by the customer, where applicable, or by blocking the device's functionalities.

Complaints regarding the Product must be submitted in writing, and the existence of a defect must be proven. Vorwerk Romania shall not be liable if the defect did not exist at the time of delivery of the Product or if the customer was aware of the defect at the time of purchase. Complaints must be submitted within 14 days from receipt of the Product. After this period, complaints shall be considered invalid and shall have no legal effect.

The Product is covered by a warranty for parts and labour, including Vorwerk Comfort Service, in accordance with the conditions of Vorwerk Romania, starting from the date of delivery. The Product benefits from a two (2) year warranty. This warranty does not apply:

• in the event of improper use, normal wear and tear, abnormal maintenance operations, or lack of maintenance and/or hygiene;

• in the event of use of accessories or equipment other than those supplied by Vorwerk Romania, or spare parts other than original VORWERK parts;

• in the event of intervention or modification of the device by an unauthorised third party or by the customer;

• in the event of failure to follow the operating instructions;

• in the event of connection to a non-compliant electrical installation;

• in cases of force majeure, such as natural disaster, lightning, flood, fire, accidental event, or external cause;

• in the event of a defective Wi-Fi or Bluetooth connection, or the absence of Wi-Fi or Bluetooth connectivity, for any reason.

The above provision does not affect the provisions relating to hidden defects and (non-)conforming delivery.

In the event of non-compliance with the safety rules provided in the Product’s operating instructions, Vorwerk Romania shall not be responsible for damages caused to the customer or third parties, whether involving animals or property. Any accident must be reported immediately to Vorwerk Romania, which may request the device for inspection. Under no circumstances may the condition of the device be altered after the accident.

The customer has the right of withdrawal within 14 days from receipt of the Product, including when the Product is received through a third party. To exercise the right of withdrawal, the customer may use the withdrawal form provided and complete it, or may submit a statement mentioning the order number and the decision to return the order. The Product must be returned in its original packaging to the address indicated by Vorwerk Romania:

During the withdrawal period, the customer must handle the Product and packaging with care. This means that the customer may only unpack the goods to determine whether they wish to keep the Product or not. In the event of withdrawal, the customer is responsible for the costs of returning the Product and for any depreciation or damage to the Product caused by handling beyond what is necessary to establish its nature, characteristics, and operation, as well as for the costs of new packaging. In the event of damage to the Product or packaging, Vorwerk Romania will invoice any repair costs and/or the full value of the damaged Product or packaging.

The customer's personal data is collected and processed by Vorwerk Romania, which acts as the data controller.

Vorwerk Romania refers to its Privacy Policy, which can be consulted on its website at this link XXX and which also specifies the data processed, the legal bases and purposes of processing, as well as the rights and obligations relating to the processing of personal data. By placing an order, the customer confirms that they have read and accepted the Privacy Policy.

If any provision of the order and/or the GTC is or becomes wholly or partially invalid, this shall not affect the validity of the remaining provisions. The parties shall, in good faith, replace the invalid provisions with an equivalent provision that best reflects the intention of the order and/or the GTC. In the event of total or partial invalidity, the court may always mitigate the invalidity and limit it to the unreasonable part.

The order, the sale, its execution, etc., as well as the GTC, are governed by Belgian law. Any disputes relating to or arising from the order and/or the GTC shall fall under the exclusive jurisdiction of the courts of Brussels.
